Terms of Service (the “Agreement”)

This Agreement is made between Petz Pack, a Limited Liability Company, and the pet owner upon rendering a service request.

Owner agrees to pay the rate for pet care provided on pickup from Petz Pack, LLC, or one of its supported locations.

Owner further agrees to pay all costs and charges for special services requested that are not included in the base boarding rate (baths, nail trims, transportation, etc.) during the period the pet is in the care of Petz Pack, LLC, or one of its supported locations.

Upon requesting service, the owner specifically represents to Petz Pack that the pet has not been exposed to any contagious diseases within a 30-day period before drop-off. During the period of this agreement, the owner also agrees to notify Petz Pack of any known exposure of a pet to a communicable disease and to hold the pet out of attending Petz Pack or one of its supported locations until the pet is symptom-free for a minimum of 30 days or with written veterinary clearance.

Contagious Illness & Vaccination Policy
For the health and safety of all pets, owners must confirm that their pet is up to date on core vaccinations (including rabies, distemper, and Bordetella) before using Petz Pack services. Petz Pack requires clients to upload vaccination records during account registration through the client portal on our website.

Petz Pack will periodically request updated vaccination records, and owners must upload new records as needed. Failure to provide up-to-date records may result in the denial of services until verification is received.

In the event that the state of the pet’s health requires professional medical attention, Petz Pack, in its sole discretion, may engage the services of a veterinarian. The owner is responsible for all veterinary expenses incurred during their pet’s stay, unless the illness or injury results from negligence on the part of Petz Pack or its supported locations. If an emergency occurs and the owner cannot be reached, Petz Pack may seek veterinary care at its discretion, and the owner agrees to cover all related costs.

The owner understands they are responsible for ensuring their pet is free of contagious conditions and up to date on preventative care (vaccines, fleas, ticks, heartworm, mites, mange, etc.). Petz Pack will not accept a pet with visible signs of contagion for boarding. The owner acknowledges that Petz Pack has taken reasonable precautions to safeguard against infectious diseases but will not hold Petz Pack or its supported locations liable for any illnesses contracted during the service period.

The owner certifies the accuracy of all information provided about the pet upon “Joining the Pack” and understands that not all behaviors are observable during a meet and greet. Therefore, Petz Pack and any of its supported locations reserve the right to deny admittance to the owner’s pet for any reason at any time.

The owner acknowledges responsibility for keeping all provided information current and will not hold Petz Pack responsible for preexisting medical conditions, ingestion of unexpected items, unknown allergic reactions, or other unforeseeable circumstances when reasonable care is being provided by Petz Pack and one of its supported locations.

The owner understands that interactive daycare service is provided and, therefore, recognizes and accepts potential risks involved in such an activity. The owner further understands that certain risks are beyond the control of Petz Pack or one of its supported hosts when reasonable care is provided and will not hold Petz Pack or one of its supported hosts liable for injuries unless specifically caused by Petz Pack or one of its supported hosts.

If it is proven that reasonable care was not provided by Petz Pack or one of its supported locations, it is expressly agreed by the owner that Petz Pack’s liability shall not exceed the lesser of the current chattel value of the pet of the same species or the sum of $300 per animal admitted.

Abandonment Policy
If an owner fails to pick up their pet within 10 days after the scheduled pickup date and is unreachable, the pet will be deemed abandoned. Petz Pack will make reasonable efforts to contact the owner during this period. After 10 days, Petz Pack reserves the right to rehome the pet or transfer it to a no-kill shelter. The owner will be responsible for all additional boarding fees incurred during the extended stay, billed at the standard daily rate.

Governing Law & Arbitration
This Agreement shall be governed by and construed in accordance with the laws of the State of Alabama, without regard to its conflict of law principles.

Any controversy or claim arising out of or relating to this Agreement, its breach, or any alleged negligence by either party shall be exclusively resolved through binding arbitration under the rules of the American Arbitration Association (AAA). The arbitration shall be conducted in [City, Alabama], and the decision of the arbitrator shall be final and enforceable in any court of competent jurisdiction.

Cost Responsibility:
Each party shall bear its own arbitration costs, including filing fees, arbitrator expenses, and attorney’s fees, unless the arbitrator determines otherwise. However, the prevailing party shall be entitled to recover all reasonable arbitration fees and legal costs from the non-prevailing party.

Exceptions:
Petz Pack may pursue legal action in small claims court for disputes related to unpaid fees. Additionally, any disputes under $5,000 may be brought in small claims court instead of arbitration, at the discretion of the pursuing party.

By signing this Agreement, both parties waive any right to a jury trial or court proceeding for disputes covered by this clause.

Media Release Policy
Petz Pack is sensitive to religious and other reasons for opting out of media release. Please contact Petz Pack directly via email if you do not wish for your pet to be photographed or recorded. Unless an express request is received:

• I authorize Petz Pack to make use of my pet’s picture and name on the website, business Facebook page, brochures, and advertising.
• I understand that I am to receive no compensation for these pictures and information.
• Petz Pack shall have complete ownership of the pictures and website usage.
• I give Petz Pack the right to use my pet’s name, likeness, and biographical material to publicize the business and its services.
• I authorize Petz Pack to photograph my pet and record their likeness for use on the website, brochures, and advertising, whether by film, videotape, magnetic tape, digital recording, or other means.
• I further understand that the master pictures remain the property of Petz Pack and that there will be no restrictions on the number of times my pet’s name and likeness may be used.
• I further understand that my pet’s pictures may be used by Petz Pack’s supported locations for the purposes of the daily photo update only. All advertisement rights and other usage rights released refer to Petz Pack, LLC, only.

Final Provisions
This Agreement contains the entire agreement between the parties. All terms and conditions of this Agreement shall be binding on the heirs, administrators, personal representatives, and assigns of the owner and Petz Pack.

Reasonable care is provided in that Petz Pack and its supported locations offer personalized care according to the care information provided by the owner. Petz Pack and its supported locations ensure constant attention to safety procedures and do not leave dogs alone together, unattended. Petz Pack maintains clean and debris-free homes and yards in accordance with safety protocols. Petz Pack performs visual inspections and will not accept a visibly contagious pet for boarding.
